Jammu’s Muslim belts, 28 FIRs registered for bovine slaughtering since 2009

in possession of Greater Kashmir reveal how the controversial law is being
regularly used mostly in Muslim-majority districts of the region.
At
a time when Kashmir is demanding scrapping of an archaic law prohibiting
slaughter of bovine animals in the state, it has come to fore that the
contentious provisions of Ranbir Penal Code are being frequently used in Jammu
province. As many as 28 FIRs were registered in the province under section
298-A, 298-B, 298-C of the Ranbir Penal Code—the provisions that criminalize
slaughtering of bovine animals in the State—during the past six years.
Documents in possession of Greater Kashmir reveal how the controversial law is
being regularly used mostly in Muslim-majority districts of the region. In a
communiqué (No: Legal/ZPHQ/WPPIL/24/26594, dated : 24-10-2014), the J&K
police have communicated to the Divisional Commissioner Jammu that 30 FIRs were
lodged against people in the region for slaughtering/killing of bovine animals
since 2009. Of these, 28 cases were registered under Section 298-A, 298-B
and 298-C RPC, the document reveals. “It is submitted that reports received
into the matter from District SSPs of Jammu zone reveal that no such activity
of slaughtering/killing of bovine animals on regular basis for commercial
purposes is being undertaken in their respective jurisdictions. However, some
sporadic incidents of slaughtering/killing of bovine animals were reported in
the below-mentioned districts/ police stations during the last five years and
the current year for which cases under relevant sections of law have been
registered to bring the guilty to book,” the document states. Since 2009,
three FIRs each were lodged in Doda and Ramban under the law, two in Udhampur,
four in Reasi, nine in Rajouri, three in Kishtwar, one in Jammu and five in
Kathua district. Details of some of the FIRs registered in the province are: On
September 20, 2009, FIR No. 47/2009 under section 298-A RPC was registered at
Police Station Thatri, Doda with regard to slaughtering/ killing of a bovine
animal by Abdul Qayoom son of Shamas Din of Banola Chiralla Thatri . However,
after investigation, the case was closed as “not admitted” vide final report
number 02, dated March 23, 2010. On April 19, 2014, FIR No. 19/ 2014 under
section 298-A RPC was registered at police station Chanderkote on a reliable
information that two persons namely Parvaiz Ahmad son of Ghulam Muhammad and
Abdul Latief son of Abdul Jabbar Sheikh of Qassal Tehsil Ramban along
with other known persons slaughtered one pet calf in the village. During
the course of investigation, police arrested the accused and after completion
of investigation, challan of the case was produced in the court of the law on
August 4, 2014 where the same is still sub-judice. On November 24, 2010, it was
reliably learnt at Police Station Chenani that one Muhammad Afzal son of Ghulam
Muhammad Bhat of Befber Urigam district Kulgam at present shopkeeper at
Narsoo Nallah has kept/cooked the meat of bovine animal at his shop and
the people of the area have objected to the same. On this, case FIR No. 121/2010
under section 298-B RPC was registered at police station Chenani. After
investigation, Challan of the same was produced in the court of the law on
September 6, 2011 for judicial adjudication. However, during the course of
trial, the accused expired resulting which the proceedings were abated. On
September 12, 2009, reliable information was received at police station
Kalakote to the effect that Majid Shah of Pundal and others have slaughtered
one ox at Sonchal forest. On this information, FIR No. 60/2009 under section
298-A, 34 RPC was registered at Police station Kalakote and investigation was
entrusted to Inspector Rajinder Kumar. During the course of
investigation, the IO completed all the legal formalities and challaned the
case in the court of the law where the same ended in acquittal on March 29,
2014. On December 25, 2011, case FIR No. 23/ 2011 under section 298-A, 34 RPC
was registered at Police Station Malhar regarding slaughtering of an ox by some
people at village Thal. The challan of the same was produced in the court of
law on July 25, 2012 for judicial adjudication.
